This Agreement is between you and kelly-mahler.com (with its affiliates, “Mahler,” “we,” or “us”). By using kelly-mahler.com, purchasing or using any Resource, or accessing any aspect of our Services, you agree to the following Terms and Conditions. 1. Definitions
- Resource: Content or products obtained through the Digital Resources Store, such as books, courses, activity cards, and other content. · Digital Resources Store: Our online store, located at www.kelly-mahler.com/shop/.
- Service: The provision of the Digital Resources Store, Resources, support, and other services provided to users of the Digital Resources Store and Resources.
- Mahler Services: The website features, products, and services offered when you visit or shop at kelly-mahler.com.
2. Licenses & Access
General License.
Subject to your compliance with these Terms and payment of applicable fees, Mahler grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal, non-commercial use of Mahler Services. Restrictions include, but are not limited to:
- No resale or commercial use of Mahler Services or content.
- No framing or use of proprietary information without written consent.
- No misuse of Mahler Services; use permitted by law only.
- The licenses granted by Mahler terminate if you do not comply with these Conditions of Use or any Service Terms.
Individual License & Use of Resources
When you purchase The Interoception Curriculum (or any Resource from Kelly-mahler.com), you are receiving a single-user, Individual License. That means it’s just for you, or for the specific person you’re buying it for (“Assignee”).
The good news is, once purchased, it’s yours to use forever—unlimited use for one person! Kelly-mahler.com grants to the purchaser, for use by one Assignee, a non-exclusive, perpetual, irrevocable, non-transferable, non-sublicensable, worldwide, limited license to view, use, download, or print such Resource solely for personal, educational, and instructional use (“Personal Use”).
This means you can:
- Use the curriculum/resources for your own clients, students, children at home, or personal study.
- Print and copy the downloadable materials for your own Personal Use (such as worksheets for your own clients or students).
- Assign the Resource to one Assignee. Once an Assignee has been designated, the license cannot be used by any other individual. For example, you can purchase a license for yourself, as a gift for another person, or as an organization purchasing for a staff member. A single transfer to the intended Assignee is permitted, but licenses may not be reallocated or shared.
But there are a few important limits:
- It can’t be shared with other professionals (even within the same clinic, school, or district).
- It can’t be posted online, uploaded to shared drives, or made accessible to others in any digital format.
Examples:
- If you’re a teacher, you can use the curriculum with your own students year after year, but it can’t be shared with other teachers unless they each have their own license.
- If you’re a school-based OT or SLP in a district, the license covers only your own caseload, not your entire OT or SLP team’s caseload.
- If you work at a private clinic, you can use the curriculum with your clients, but it can’t be shared with other therapists at the clinic unless each therapist has their own license.

3. Digital Resources Terms of Use
Use of Resources. Upon your access or download of any Resource and payment of any applicable fees (including applicable taxes), Mahler grants you a non-exclusive right to view, use, download, and print such Resource solely for your personal, non-commercial use.
Termination. Your rights automatically terminate if you fail to comply with any term of this Agreement.
Risk of Loss. Risk of loss transfers to you once a Resource is downloaded or accessed.
4. Conditions of Use
Additional Terms. When you use certain Services (e.g., Your Account, Live Online Courses, Digital Resources), additional terms may apply. If inconsistent, those Service Terms will control.
Occupational Therapy Services Disclaimer. Mahler is a licensed occupational therapist. All methodologies should be used with a duty of care, considering individual needs and history. Mahler is not certified to examine each end user and cannot diagnose or treat medical conditions. Users must ensure clients are properly assessed and cleared by a licensed medical provider prior to implementing methodologies.
5. Privacy
Please review our Privacy Notice, which governs your use of Mahler Services.
6. Intellectual Property
Copyright. All content included in or made available through any Mahler Service is the property of Mahler and protected by U.S. and international copyright laws.
Trademarks. Graphics, logos, icons, scripts, products, and service names are trademarks or trade dress of Mahler. They may not be used without express written consent.
7. Your Account
- You may need a Mahler account to use certain Services.
- You are responsible for maintaining confidentiality of your account and password.
- By creating an account, you warrant refraining from unauthorized, unlawful, or abusive conduct.
- Mahler sells products for children but only to adults; minors may only use with parent/guardian involvement.
- Mahler reserves the right to refuse service, terminate accounts, remove content, or cancel orders at its discretion.
8. Disclaimers, Limitation of Liability & Risk of Loss
- Warranty. Mahler Services are provided “AS IS.” No warranties are expressed or implied regarding accuracy, adequacy, or completeness.
- Limited Liability. Any damages are limited to the amount actually paid for the Services or Resources in dispute. Mahler is not liable for actions beyond its control.
- Risk of Loss. For digital Resources, risk passes upon download or access. For physical items, risk passes upon delivery to the carrier.
9. Disputes & Applicable Law
- Disputes/Arbitration. Any dispute or claim arising from this Agreement or Mahler Services is subject to binding arbitration/mediation per kelly-mahler.com Conditions of Use.
- Applicable Law. These Terms are governed by the laws of Pennsylvania, with jurisdiction in Dauphin County, Pennsylvania.

11. Payment Terms
You agree to pay all fees and applicable taxes associated with your purchase at the time of order. Prices are listed in U.S. dollars unless otherwise noted. If your payment method is invalid or unauthorized, we may suspend or cancel your order. International buyers are responsible for compliance with their own country’s tax laws, including but not limited to VAT or import duties.
12. Refunds & Returns
- Digital Products. All sales of digital Resources (including courses, downloads, and other electronic materials) are final. We do not offer refunds once materials are accessed, downloaded, or delivered.
- Physical Products. If you purchase a physical product, you may request a return within 30 days of delivery if the item is unused, unopened, and in its original packaging. You are responsible for return shipping unless the item was defective or shipped in error. Refunds are issued to the original payment method after the returned product is received and inspected.
- Services. Live events, workshops, or consultation fees are non-refundable unless otherwise expressly stated at the time of purchas
